Australia Student Visa Dependent Family Restrictions Take Effect, Most Students Excluded
The Australian government implemented student visa dependent family restrictions from October 2. Dependent Family Application Restrictions from October 2
Australia implemented new regulations on October 2 that prevent most international students from bringing dependent family members. Julian Hill, Assistant Minister for International Education, announced in a speech at the National Immigration Conference that the measure took effect that day.
Exceptions are limited to PhD students, Australian or foreign government scholarship recipients, and students from ASEAN or Pacific island nations. Students must apply for dependent family members when submitting their initial student visa application, and applying for additional dependents after visa approval is not permitted.
Assistant Minister Hill stated that "the government has no intention of separating families already in Australia," and grace measures will apply to existing dependents. The same regulations apply to temporary graduate visa holders.
Reduced Pathways for Course Changes During Study
Cases where students can change their visa after starting their main course are limited to three: extension of course completion period due to medical leave, course failure, or educational institution closure; transfer between educational institutions during study; or progression to a higher level course in the Australian Qualifications Framework after course completion.
Applications to switch from higher education to vocational education courses are explicitly prohibited.
From July 1, 2027, students wishing to transfer to another educational institution must obtain a new student visa through a dedicated transfer pathway. Students can only apply for transfer after completing at least 6 months of their main course at the institution specified on their visa. Assistant Minister Hill stated that "young people sometimes choose the wrong course and have legitimate reasons to transfer," but added that "the scale and patterns were at unacceptable levels, making these requirements necessary."
Students cannot begin classes at the new educational institution until receiving the new visa, and the expiration date of the new visa will remain the same as the existing visa.
As a transitional measure, students cannot transfer between educational institutions for 12 months after commencing their main course. This regulation will remain until the new transfer visa pathway begins in July 2027.
Working Holiday to Student Visa Conversion Blocked
Holders of numerous temporary visas, including working holiday, training visas, and temporary employment visas, can no longer apply for student visas within Australia.
Assistant Minister Hill explained that these changes are part of broader efforts to reduce immigration levels that rose after COVID-19. Net overseas migration has already decreased by nearly 50% from its post-COVID peak, but "further reductions are needed to give housing supply a chance to catch up," he said.
There are currently approximately 215,000 working holiday visitors, and the government aims to stabilize this at around 200,000. Assistant Minister Hill stated that "the goal is not to drastically cut the program but to stabilize it at around 200,000."
Industry Reaction and Government Position
Ian Pratt, Managing Director of Lexis English, criticized that "this is not how a competent government manages a major export industry. There is no plan, no long-term strategy, no stable destination." He particularly stated that removing the pathway from working holiday to study is "another devastating blow" to the vocational education sector.
Assistant Minister Hill emphasized that "Australia welcomes genuine students pursuing premium Australian education," but "the government will not step back from efforts to manage the size and composition of the enrolled student market." He added that "for the continued success of international education, a cold focus on integrity and excellent student experience is needed, and must be measured not only by the quantity but the quality of students Australia attracts and welcomes."
